Terms of Service

1. Acceptance of Terms

By accessing the website and using the table reservation service, you accept these Terms of Service in full. If you disagree with any part of these Terms, please do not use the service. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Baš Nas d.o.o.

2. Service Description and Provider

Baš Nas d.o.o. provides an online platform for reserving tables and pre-ordering drinks for music and cultural events held at the venue. The service constitutes an information society service within the meaning of the Croatian E-Commerce Act (NN 173/03 and amendments). By completing a reservation you enter into a binding contract with the service provider.

Mandatory information about the provider required under the E-Commerce Act is set out in the Impressum section at the bottom of this page.

3. Age Requirement

The service may only be used by persons aged 18 or over. By using the service you confirm that you are at least 18 years of age. Minors must not use this service or make payments. The service provider reserves the right to void a reservation and deny entry if it is established upon arrival that the booking was made by a minor, without entitlement to a refund.

4. Mandatory E-Commerce Disclosures

In accordance with the Croatian E-Commerce Act (NN 173/03 and amendments), we provide the following information before you conclude an electronic contract:

  • Steps to conclude the contract: select date → select table → enter contact details and drink order → review summary and total amount → complete payment via Stripe. The contract is concluded when you receive an email confirmation with your reservation reference number.
  • Storage of the contract: your reservation is stored in our system and is available to you on request by email.
  • Languages: the contract is available in Croatian and English.
  • Error correction: you may correct any input errors at any stage of the reservation process before confirming payment. After the contract is concluded, changes may be requested by contacting info@byrubinic.com.
  • Codes of conduct: the service provider is not bound by any code of conduct.

5. Reservations and Payment

A table reservation requires payment of a deposit or the full amount at the time of booking via the secure Stripe payment gateway. The exact amount is displayed in the reservation summary before payment is confirmed.

Any remaining balance (where a deposit was paid) is settled on-site on the day of the event.

Payment may be made by cards supported by Stripe (Visa, Mastercard, etc.). All payments are processed in euros (EUR). Stripe is responsible for the security of payment transactions; card data never passes through our servers.

A reservation is confirmed only after Stripe confirms successful payment and you receive an email confirmation with your reservation reference number (format: BN-YYYY-XXXX).

6. Right of Withdrawal

Under Art. 79(1)(13) of the Croatian Consumer Protection Act (NN 19/22 and amendments), implementing Art. 16(l) of EU Directive 2011/83/EU on consumer rights, the statutory 14-day right of withdrawal does not apply to contracts for leisure services (including event table reservations) where the contract specifies a particular date or period for performance of the service.

Because your reservation is tied to a specific event date, the 14-day statutory cancellation right is not applicable to this service. Guest cancellation terms are set out in section 8 below.

7. Fiscal Invoices and Tax

Every successful payment is recorded in the fiscal system in accordance with the Croatian Fiscalisation Act (NN 133/12 and amendments). A fiscal invoice is automatically sent to your email address.

If you are a legal entity or sole trader requiring a VAT invoice (R1 račun), you must enter your company tax ID (OIB), name, and registered address when making the reservation. Subsequent requests for a VAT invoice cannot be accommodated. The service provider is registered for VAT under the Croatian VAT Act (NN 73/13 and amendments).

8. Cancellations and Refunds

Guest cancellation policy:

  • More than 48 hours before the event: cancellation is possible with a refund of the amount paid, less payment processing fees. Submit your request to info@byrubinic.com.
  • Less than 48 hours before the event: the deposit is non-refundable. For full upfront payment ("full bottle") the entire amount is non-refundable.
  • No-show (non-attendance without prior cancellation): no refund is due.

Organiser cancellation and force majeure:

The organiser reserves the right to modify the programme, change the date, or cancel an event due to extraordinary circumstances beyond its reasonable control (force majeure, decisions of competent authorities, natural disasters, epidemics, security incidents, etc.). In such cases guests will be offered either:

  • re-registration for a rescheduled date, or
  • a full refund of the amount paid, processed within 14 business days.

Refunds are returned to the same payment instrument used for the original payment, via Stripe. The service provider is not liable for indirect losses arising from cancellation (e.g. travel or accommodation costs).

9. Stripe — Payment Service Provider

Payments are processed by Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland), a regulated payment institution authorised under the EU Payment Services Directive (PSD2 — Directive 2015/2366/EU). Stripe is PCI DSS Level 1 certified.

Card data is entered exclusively on Stripe's pages, subject to Stripe's Privacy Policy (stripe.com/privacy). Baš Nas d.o.o. does not at any point receive or store your payment card data.

10. Guest Conduct and House Rules

Guests must comply with the venue's house rules, staff instructions, and applicable law and order regulations. Entry may be subject to presentation of a valid identity document.

Management reserves the right to refuse entry or remove a guest who:

  • disrupts public order or the safety of other guests or staff
  • is visibly intoxicated or under the influence of substances upon arrival
  • brings prohibited items onto the premises (weapons, pyrotechnics, etc.)
  • fails to comply with instructions from security or venue staff

In such cases no refund is due.

11. Intellectual Property

All content published on this website (text, graphics, logos, images, music, video, software and code) is owned by Baš Nas d.o.o. or is used under a valid licence. Reproduction, distribution, translation, adaptation, or public display of any part of the content without the prior written consent of the rights holder is prohibited. The trade mark and name "Baš Nas" are protected marks of their respective owners.

12. Liability and Limitation of Liability

The service provider is not liable for:

  • Indirect or consequential losses (loss of profit, travel or accommodation costs, etc.)
  • Loss or damage to guests' personal belongings or valuables at the venue
  • Temporary unavailability of the website or service due to maintenance or force majeure
  • Errors or omissions caused by inaccurate information provided by the guest during reservation
  • Damage arising from unauthorised use of a reservation by third parties

The service provider's maximum liability in all cases is limited to the amount of the reservation paid, except in cases of wilful misconduct or gross negligence, or where otherwise provided by mandatory law (including the Consumer Protection Act).

13. Dispute Resolution — ODR Platform

Any complaint or claim may be submitted in writing to info@byrubinic.com. We are committed to responding within 15 days.

Pursuant to Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes, the European Commission has established an online dispute resolution (ODR) platform available at: ec.europa.eu/consumers/odr. This platform is intended for consumers who wish to resolve a dispute with an online trader without going to court.

Under the Croatian Consumer Protection Act (NN 19/22), as a service provider we are available to participate in out-of-court consumer dispute resolution. We will provide information about the competent mediation body upon request.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Croatia. For consumer disputes, applicable EU law also applies (Rome I Regulation, Consumer Rights Directive). All disputes that cannot be resolved out of court shall be referred to the competent court in Split, without prejudice to consumers' rights to bring proceedings before the courts of their country of domicile under Regulation (EU) No 1215/2012 (Brussels I bis).

15. Severability

If any provision of these Terms is found to be void, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect. The void provision shall be replaced by a legally permissible provision that is closest in meaning to the original intent of the parties.

16. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or a notice on the website at least 14 days in advance. Continued use of the service after changes constitutes acceptance of the updated Terms. The date of the most recent revision is shown at the top of this page.
